Pet puppy Sales Contract - An agreement between KalaMals Kennel and the Buyer

After check deposit the remainder of balance must be paid in the form of cash, certified check or money order.
Payment in full must be made before the buyer takes possession of the dog.

The puppy's registered name must contain KalaMals as a prefix as part of the registered name.

A pet PUPPY is defined here to be a Alaskan Malamute puppy which is in good health at the time of sale, and embodies the characteristics of the Alaskan Malamute breed .

This PUPPY is registered with a limited registration, which will prohibit breeding and registering offspring. (The BUYER agrees this female PUPPY is to be spayed at the appropriate age, and veterinarian confirmation of this proceedure must be supplied to the BREEDER.) The BUYER agrees to maintain the puppy's health in good condition, and to provide yearly examinations, vaccinations, heartworm test, and any other usual procedures necessary to assure good health. Females which are purchased as family companions should be spayed when they near maturity, before nine months of age.Males not until at least 2 years of age

The BREEDER guarantees the above described dog to be healthy at the time of the sale. The BREEDER does not assume any liability for any injury to said puppy after delivery.

The BUYER agrees to have this puppy examined by a veterinarian within 72 hours of delivery. If the puppy is found to be other than healthy by the BUYER'S veterinarian, it shall be returned to the BREEDER immediately, and the purchase price will be refunded.( Simple diarrhea is not an illness ). If the puppy is returned to breeder , the buyer shall assume any expenses associated with returning the puppy. In no event shall the amount of any refund, reimbursement or liability on the part of KalaMals Kennel to the buyer be greater than the purchase price of the dog. All appropriate shots for the PUPPY'S age have been given, and a record of this vaccination history is supplied. No veterinary or other costs of keeping the puppy/dog, or any other costs incurred by the Buyer resulting from his/her ownership of the puppy/dog, will be paid by the Seller to the Buyer of the puppy/dog under any circumstances. There are many factors that can influence growth and development, such as diet, exercise, weight gain, etc.. The BUYER assumes the responsibility to carry on with the appropriate vaccinations, exercise and feeding schedule, as supplied by the BREEDER. MOST PARTICULARLY, the BUYER agrees to keep the puppy slim throughout it's normal growth period. The BREEDER can offer no further guarantees once the care of the puppy is no longer under their control.

The BUYER hereby agrees that if at any time the Buyer cannot take proper care of the puppy, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) take the PUPPY back or (b) assist the BUYER in finding a suitable home for the PUPPY. In the event that the dog will be returned to the breeder and buyer shall sign over all AKC paperwork to breeder Julie Kalamja as sole owner , No money will be refuded .

The BUYER agrees to notify the BREEDER of any changes of address during the PUPPY'S lifetime. The Buyer agrees to provide a suitable fenced area for this puppy.
Beside good and reasonable care, the buyer agrees to:
a) Allow the dog to live in your home, as a participating family member and to treat the dog humanely with proper safeguards taken for the care and safety of the dog;
b) annual veterinary checks, including yearly heartworm tests, to properly administer a heartworm preventative, and any other health care needs;
c) to confine the dog in a fenced yard, kennel run or walk on a leash but NOT restrain the dog on a rope, chain or tether;
d) to keep the dog clean and properly groomed, provide the dog with human living conditions and adequate housing;
e) to attend and participate with the dog in at least a basic obedience course by at least six months of age no later than eight months of age using positive reinforcement

Purchasers agree to notify the breeder if any such contingency arises . The buyer agrees and promises to never take this dog to a humane society or animal shelter; to never train, use or allow the dog to be used in dog fighting, medical research, protection training, attack training or as a guard dog for self or any agency, firm, corporation or organization. If dog is found to have been sold or given away without Breeders knowledge and said breeder discovers this, Breeder will take legal action and original purchaser of the dog will be responsible for all legal expenses incurred.

Buyer agrees not to sue Seller and to pay any and all court /attorneys fees incurred by the Seller should any suit be brought against the Seller in regard to this puppy/dog by any person. Buyer signifies acceptance of this condition by initialing here:_________________ Date:_______

The BREEDER neither makes or implies any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer with respect to this sale. Ile Buyer's signature below indicates that he/she has read, agrees and does understands all the conditions of the Sales Agreement and Contract of Sale.

The Breeder reserves the right to cancel a reservation should it be determined that a client may not be a suitable home during the term of the selection or waiting process. KalaMals reserves the right to cancel any reservation for any reason at its sole discretion. Upon such cancellation, a refund of the deposit shall be made . Persons placing reservations for the purchase of a Puppy hereby agree to and do indemnify and hold harmless KalaMals from any and all damages or liability resulting from such cancellation. By signature, the buyer accepts all the foregoing and constitutes this as a binding contract.

SHOULD THE DOG BE OBTAINED BY FALSE PRETENSES AND IF FAILURE TO COMPLY WITH ALL OF THE ABOVE AGREEMENTS VOIDS ALL GUARANTEES AND IS GROUNDS FOR REPOSSESSION OF THE DOG AND ITS REGISTRATION PAPERS WITHOUT ANY COMPENSATION TO THE OWNER.
